Smoke Alarm Compliance in NSW: What Every Homeowner Needs to Know

Smoke alarm legislation in New South Wales has evolved significantly, and many homeowners are unaware of exactly what’s required. Whether you’re renting out a property, selling, or simply want to ensure your family is protected, here’s what you need to know.

Current NSW Requirements

Under the Environmental Planning and Assessment Regulation 2021, all NSW homes must have working smoke alarms. The key requirements are:

  • Smoke alarms must be installed on every level of the home, inside every bedroom, and in hallways adjacent to bedrooms.
  • Alarms must be either hardwired (240V) or powered by a non-removable 10-year lithium battery.
  • Interconnected alarms are strongly recommended — when one activates, they all sound.
  • Alarms must be photoelectric (not ionisation) type. Ionisation alarms are slower to detect slow-burning fires, which are the most common and most dangerous type in residential settings.

When Do the Rules Apply?

The full requirements apply immediately to new homes and homes undergoing substantial renovations. For existing homes, the rules apply upon sale or lease renewal. Queensland has stricter timelines than NSW, but NSW homeowners should not be complacent — the laws are likely to tighten further.

What About Battery-Only Alarms?

While 9V battery alarms are still technically permitted in some existing homes, they’re not recommended. Batteries are often removed when the alarm activates due to cooking smoke, and forgotten. A hardwired alarm with battery backup, or a 10-year sealed battery alarm, is far more reliable.

Landlord Obligations

If you rent out a property on the North Shore, you are responsible for ensuring smoke alarms are installed, functional, and compliant before each new tenancy begins. Failure to comply can result in significant fines and, more importantly, puts tenants’ lives at risk.
